General Terms and Conditions (AGB)

1. scope of application

These General Terms and Conditions (GTC) apply to all orders placed via our online shop. bärnd book & leaf be concluded. The version of the GTC valid at the time of the order shall apply. Status June 2025

2. conclusion of contract

The products presented in the online shop do not constitute a legally binding offer, but a non-binding invitation to order.
By sending an order, the customer submits a binding purchase offer.

Acceptance of the offer is generally effected by an order confirmation by e-mail.
However, if the customer selects a payment method during the order process where payment is made immediately after the order is sent (e.g. credit card, instant bank transfer, EPS), the request for payment shall be deemed to be acceptance of the offer. In this case, the contract is bindingly concluded when the payment process is initiated.

3. prices & shipping costs

  • All prices are quoted in euros (€) and include VAT.
  • Shipping costs:
    Shipping is free of charge for orders over €45.
    Shipping costs of €4.90 will be charged for orders under €45.

Note on fixed book prices:
In Austria, books are subject to statutory fixed book prices in accordance with Section 5 of the Book Price Fixing Act (BuchPrG). Sales below the fixed price are not permitted. Books are therefore excluded from all discount campaigns.

4. delivery & dispatch

  • Delivery takes place within Austria to the address provided by the customer.
  • The delivery time is usually 2-5 working daysbut may differ in individual cases.

5. payment

The following payment methods are available:
Credit card
PayPal
EPS bank transfer

Payment is due immediately after conclusion of the contract.

6. right of cancellation & returns

6.1 Right of cancellation

You have the right to cancel the contract within 14 days without giving reasons. The cancellation period begins on the day on which you receive the goods.

6.2 Return of goods and costs

  • The consumer bears the costs of the return shipment.
  • If the goods have been delivered damaged or incorrectly, we will of course bear the return costs.

6.3 Repayment

We will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the consumer's choice of a more expensive delivery method), within 14 days after receipt of the declaration of cancellation and the return of the goods.

7. reservation of title

The goods remain our property until full payment has been made.

8 Warranty & Liability

  • We accept no liability for damage caused by improper use or external influences.

11. severability clause

Should individual provisions of these GTC be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision.

12 Applicable law & place of jurisdiction

Place of jurisdiction
If the contractual partner is an entrepreneur, the place of jurisdiction shall be the registered office of our company or - optionally - another expressly agreed place of jurisdiction (§ 88 ff. JN).
If the consumer is a consumer, the mandatory provisions of § 14 KSchG apply: The consumer can only be sued at his domicile, habitual residence or - if within Austria - at the place of his employment. Any further agreement on the place of jurisdiction to the detriment of the consumer is invalid.

13 Payment period and due date

  • Prepayment: When selecting the payment method Prepayment the invoice amount must be paid within 7 days to the specified account after receipt of the order confirmation. The order will only be dispatched after receipt of payment.
  • Purchase on account: If purchase on account is offered as a payment method, the invoice amount must be paid within 14 days after receipt of the goods without deductions.
  • Instant payment methods: For payment by Credit card, PayPal or EPS the debit is made directly upon completion of the order.
  • Default: If payment is not received on time, we reserve the right to charge reminder fees and interest on arrears in accordance with the statutory provisions.

14 Product presentation and deviations

(1) The product images shown on our website are for illustrative purposes only. Due to design changes on the part of the manufacturer, there may be deviations in colour, shape or packaging. The functionality and quality of the product remain unaffected by this.
(2) Such minor deviations do not constitute a defect and do not justify a complaint or return, provided that the essential product characteristics are fulfilled.

15. price quotations and obvious errors

Should a product be offered at an obviously incorrect price due to a typing error or technical problems, we reserve the right to cancel the order. In such a case, the customer will be informed immediately and any payments already made will be refunded. A purchase contract is only concluded with our express confirmation.

16. consequences of default (default of payment, default of acceptance, default of performance)

Default of payment and acceptance
If the customer defaults on payment, we reserve the right to charge interest on arrears at the statutory rate. In addition, we are entitled to withdraw from the contract after a reasonable grace period has expired without result.
If the customer is in default of acceptance or refuses acceptance without justification, we shall be entitled to store the goods at the customer's expense and risk or to withdraw from the contract.

Default in performance (debtor's default)
If the Seller defaults on delivery, the Buyer shall be entitled to either insist on fulfilment or withdraw from the contract after setting a reasonable grace period.
The setting of a grace period shall not apply in the case of fixed-date transactions or if the seller finally refuses performance or if performance can obviously no longer be rendered on time.
In the event of culpable delay in performance (subjective delay), the seller shall also be liable for any resulting damages in accordance with the statutory provisions.
In the case of divisible performance, partial cancellation is possible; in the case of indivisible performance, the buyer is entitled to total cancellation.
The special provisions of Section 7c of the Consumer Protection Act (KSchG) also apply to consumer transactions.

17.contract language

The language used for the conclusion of the contract and the entire business transaction is German.

18.Technical steps to conclude the contract

The ordering process in our webshop comprises the following steps:

  • Selection of the desired products

  • Adding products to the shopping basket

  • Call up the shopping basket and "Continue to checkout"

  • Enter the customer data (billing and delivery address, if applicable)

  • Selection of payment method

  • Checking the order and confirming the GTC

  • Binding submission of the order by clicking on "Order with costs" (or corresponding button)
    The receipt of the order is automatically confirmed by e-mail; this does not yet constitute a contract. The contract is only concluded upon express acceptance (e.g. by confirmation of dispatch).
